Our Terms Of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by xy. Studios ("xy. Studios" or "we"). By utilizing xy. Studios' products or services, clients acknowledge and agree to abide by these Terms of Service. Your continued use of our products and services constitutes acceptance of these terms.

1. Product Guidelines


1.1 Product Responsibility

xy.Studios assumes no responsibility for any loss or damage incurred subsequent to the completion of an order and receipt of payment. Upon closure of an order by xy.Studios, the product in question becomes the sole responsibility of the client.


1.2 Client Obligations

Clients acknowledge and accept that they are solely responsible for the safekeeping and maintenance of the product upon delivery. xy.Studios shall not be held liable for any lost or misplaced products following the conclusion of the order process.


1.3 Reporting Procedure

Clients are required to promptly report any issues or concerns regarding the condition or whereabouts of the product during the active ticket period. Failure to report such issues within the specified timeframe shall absolve xy.Studios of any liability pertaining to the lost or damaged product.


1.4 Limitation of Liability

xy.Studios' liability is expressly limited to the provision of the product as specified in the order. xy.Studios shall not be held liable for any indirect, consequential, or incidental damages arising from the loss or misuse of the product. We bear no responsibility if our service (mainly liveries) are not approved by the relevant authority. This includes any liveries we provide or tools we offer for creation. While we strive to deliver high-quality products, the final approval decision rests with the relevant authorities.


1.5 Indemnification

Clients agree to indemnify and hold harmless xy.Studios, its employees, agents, and affiliates from any and all liabilities arising from the loss or damage of products.


2. Pricing

2.1 Pricing Determination Process

The price for services rendered by xy.Studios is determined by various factors, including but not limited to, the complexity of the project, the time and effort required for completion, and the perceived value of the service to the client.


2.2 Discretionary Pricing

The corresponding designer, in consultation with xy.Studios, retains the discretion to set the price for each service based on their professional assessment of the client's needs and the resources required to fulfill them.


2.3 Client Restrictions

Clients are prohibited from unilaterally altering the price of services as determined by the corresponding designer. Any request for a price adjustment must be made in accordance with the established procedures outlined by xy.Studios.


2.4 Pricing Modifications

xy.Studios reserves the right to modify prices at its discretion, provided such modifications are communicated to the client in a timely and transparent manner.


3. Purchasing and Returns


3.1 Payment Terms

All payments rendered and prices quoted by xy.Studios are deemed final and non-negotiable. Clients are expressly bound to the agreed-upon payment terms and prices upon initiation of an order.


3.2 Modification of Payment Methods

Modification of payment methods during the course of an ongoing order is strictly prohibited. Clients are obligated to adhere to the payment method initially selected upon commencement of the order.


3.3 Cancellation Policy

Clients maintain the prerogative to cancel their order at any stage; however, xy.Studios does not entertain requests for refunds under any circumstances. The act of cancellation does not absolve the client of their financial obligation to xy.Studios.


3.4 Refund Policy

xy.Studios shall only entertain requests for refunds in instances where a verifiable issue arises from our end. Dissatisfaction with the final deliverable does not guarantee a refund.


3.5 Product File Policy

We typically don't provide the source files after project completion. This includes design files, product data, and work images. In rare cases, exceptions may be made, but these will be determined on a case-by-case basis.


3.6 Dispute Resolution

It is explicitly understood and agreed that xy.Studios bears no liability for client dissatisfaction with the final product, unless such dissatisfaction is attributable to an error or deficiency on our part.


3.7 Governing Law

This purchasing and return policy constitutes a legally binding agreement between xy.Studios and the client, superseding any prior agreements, whether oral or written. Any disputes arising from or relating to this agreement shall be governed by and construed in accordance with the laws of the European Union.


4. Rushing


4.1 Discouragement of Expedited Requests

The hastening of our designers to expedite the completion of orders is strongly discouraged and may result in disciplinary action. Clients are advised to refrain from exerting undue pressure on designers to accelerate the delivery timeline, as such actions may compromise the quality of the final product and disrupt operational efficiency.


4.2 Timely Communication

It is imperative that clients adhere to the agreed-upon project timelines and communicate any reasonable adjustments or concerns in a timely manner. xy.Studios reserves the right to exercise discretion in assessing the appropriateness of any requests for expedited delivery and may levy moderation measures in cases where such requests are deemed unreasonable or detrimental to the quality of service provision.


4.3 Client Acknowledgment

Clients are reminded that the primary objective of xy.Studios is to ensure the provision of high-quality deliverables, and any attempt to circumvent established processes or timelines may result in the imposition of sanctions.


5. Reselling or Sharing


5.1 Prohibition of Unauthorized Activities

The unauthorized resale, distribution, or sharing of xy.Studios' products is expressly prohibited. Any such unauthorized activity will result in the immediate archiving of the specific product without prejudice to any other rights or remedies available to xy.Studios under law or equity.


5.2 Enforcement

xy.Studios reserves the right to impose moderation actions against offenders, including suspension or termination of access to our services and pursuit of legal remedies.


6. Order Changes


6.1 Client Obligations

Within the framework of placing an order, clients are unequivocally prohibited from effecting substantial alterations that may present an inconvenience to their designated designer. It is incumbent upon clients to comprehensively outline all relevant details in the initial format message upon commencement of their service request, thereby facilitating unambiguous direction for the designer.


6.2 Consequences of Deviation

Any deviation from this prescribed procedure may lead to consequential delays, errors, or supplementary charges, for which xy.Studios shall bear no liability.


7. Rights


7.1 Intellectual Property Rights

xy.Studios hereby asserts and retains all intellectual property rights, including but not limited to copyright and distribution rights, to all products created by our designers. This includes the right to utilize, exploit, and distribute such products without limitation.


7.2 Pricing Variations

Prices for products may vary at the sole discretion of xy.Studios and may be higher or lower than the original purchase price. This agreement supersedes any prior understandings or agreements and is binding upon the parties and their successors.


7.3 Denial Of Service

xy.Studios reserves the right, in its sole discretion, to refuse to provide service to any customer. We make no guarantees regarding the availability of any particular service. In certain circumstances, we may close an order if we believe it is necessary


8. Refunds


8.1 Refund Eligibility

Refunds shall be granted solely in cases where there is a verifiable fault on behalf of xy. Studios as established.


8.2 Fault Determination

The determination of fault shall be conducted through an objective assessment process based on criteria established by xy. Studios.


8.3 Refund Procedure

Clients seeking a refund are required to submit a formal request, providing comprehensive details and evidence substantiating the fault attributed to xy. Studios. Such requests shall be processed within a reasonable timeframe, subject to the discretion of xy. Studios.


8.4 Non-Refundable Circumstances

Refunds shall not be issued for circumstances beyond the control of xy. Studios, including but not limited to client dissatisfaction or changes in personal circumstances.


9. Membership Perks


9.1 Scope of Membership Benefits

Membership benefits are applicable solely to new orders and are not retroactively extended to previous transactions.


9.2 Currency Limitations

Discounts outlined in membership perks do not extend to orders made in USD currency. However, bulk USD orders, defined as orders exceeding 12 liveries or equivalent units, shall receive a discount ranging from 5% to 15%.


9.3 Membership Stacking

Clients are hereby informed that membership benefits, including discounts, associated with Exclusive, Premium, and XY+ memberships cannot be stacked or combined. Only one membership discount can be applied to an order.


10. Membership Payment Method


10.1 Discount Restrictions

Discounts associated with membership perks are contingent upon the payment method used for the subscription purchase.


10.2 Currency-Specific Discounts

In the event of a subscription purchase made with Robux, USD discounts shall not be applicable, and vice versa. Membership benefits are intricately linked to the payment method utilized during the subscription acquisition process.


11. xy+ Membership


11.1 Bulk Order Discount

A 25% discount is extended to bulk orders comprising 20 or more liveries. For orders not meeting the bulk criteria, including logos or apparel, a discount ranging from 15% to 20% shall be applied instead of the standard 25%.


12. Amendments


12.1 Modification of Terms

xy. Studios reserves the right to modify, amend, or update these Terms of Service at any time. Clients will be notified of any changes via email or through our platform, and continued use of our services after such modifications constitutes acceptance of the updated terms.


12.2 Review of Terms

Clients are encouraged to regularly review these Terms of Service to stay informed of any changes or updates that may affect their rights and obligations.


13. Third-Party Payment Services


13.1 Use of Third-Party Services

Clients acknowledge that xy. Studios may utilize third-party payment processing services, such as Venmo, PayPal, or others, to facilitate transactions.


13.2 Limitation of Liability

Clients understand and agree that xy. Studios shall not be liable for any breaches of data security, fraudulent activities, or unauthorized access to payment information that may occur as a result of using third-party payment services.


13.3 Third-Party Policies

Clients are encouraged to review the terms of service, privacy policies, and security measures of third-party payment processors before using their services. Any disputes or issues arising from the use of third-party payment services shall be resolved directly with the respective service provider.


13.4 Indemnification

Clients agree to indemnify and hold harmless xy. Studios from any liabilities, damages, or losses arising from the use of third-party payment services, including but not limited to unauthorized transactions, data breaches, or fraudulent activities.


13.5 Non-Liability Clause

xy. Studios expressly disclaims any liability for the actions or omissions of third-party payment processors and shall not be held responsible for any damages, losses, or liabilities arising from such actions or omissions.


14. Queue Lines


14.1 Order of Priority

The queue lines for product delivery shall follow the following order of priority: Priority Queue, Platinum Queue, Gold Queue, and Silver Queue.


14.2 Non-Stackable Queues

Clients are advised that the priority queues associated with their membership do not stack. In the event of multiple memberships, the client’s position in the queue will be determined by the highest priority queue associated with their membership.


14.3 One-Time Purchase

Clients acknowledge that the purchase of queue line priority is a one-time transaction and cannot be returned or exchanged once initiated.


14.4 Non-Transferable

Queue line priority is non-transferable and cannot be assigned or allocated to any other individual or entity.


14.5 Modification

xy. Studios reserves the right to modify the queue lines or their associated terms at its discretion, with prior notification to the client.


15. Marketplace


15.1 Third-Party Products

xy.Studios provides a marketplace platform where users may buy and sell products created by third-party designers. These products are not owned or directly controlled by xy.Studios.


15.2 Quality Assurance

While xy.Studios makes efforts to ensure the quality and authenticity of products available in the marketplace, some products may not meet the standards expected by users. xy.Studios does not guarantee the quality, accuracy, or suitability of any products listed in the marketplace.


15.3 Non-Liability

Clients acknowledge and accept that xy.Studios cannot be held liable for any issues or disputes arising from the purchase of products from the marketplace. This includes but is not limited to product defects, inaccuracies, or dissatisfaction with the purchased items.


15.4 No Refunds

Clients understand that purchases made from the marketplace are final and non-refundable. xy.Studios does not offer refunds or exchanges for products purchased through the marketplace, regardless of the reason.


15.5 Indemnification

Clients agree to indemnify and hold harmless xy.Studios, its employees, agents, and affiliates from any liabilities, damages, or losses arising from transactions conducted in the marketplace.


15.6 Dispute Resolution

Any disputes or issues arising from marketplace transactions shall be resolved directly between the buyer and the seller. xy.Studios may, at its discretion, provide assistance or mediation services, but is not obligated to do so.





Entire Agreement

This document represents the entire agreement between xy.Studios and the client, governing the terms of service. Any disputes arising from or relating to this agreement shall be resolved in accordance with the dispute resolution provisions outlined herein.


By acknowledging these comprehensive Terms of Service, clients affirm their understanding and acceptance of all the provisions outlined herein, further enhancing the protection, transparency, and compliance of our relationship.
